Only the spouse or unmarried children (under the age of 21) are eligible to be classified as H-4 dependents according to immigration law. Once a dependent child reaches his or her 21st birthday, he/she is no longer considered to be a dependent and thus is no longer eligible for H-4 status. Therefore, prior to the 21st birthday of the child, US Citizenship and Integration Services must receive the application to change the child's status from H-4 to another category (e.g. F-1) or the child must leave the US. Please contact OIS at least six months prior to the child's 21st birthday to discuss options for dependent children nearing their 21st birthday.
