H-1B Filing Fees & Supporting Documents

H-1B Fees (Note: This information can also be found within the iStart system)

A request for a new H-1B made by Indiana University requires the payment of two separate fees to the Department of Homeland Security in Laguna Niguel, California: an application fee of $320 and an anti-fraud fee of $500.

An application for an extension of H-1B status made by Indiana University requires the payment of one fee to Department of Homeland Security in Laguna Niguel, California: an application fee of $320.

The employer is prohibited from passing the cost of these fees on to the beneficiary.

In both cases, an additional and separate fee of $1000 may be paid to the Department of Homeland Security in Laguna Niguel, California for premium processing.  Premium processing guarantees adjudication by USCIS (or a fee refund) within 15 calendar days of receipt.  Consult with OIS to inquire about the necessity of paying the premium processing fee relative to your situation.

Supporting Documents (Note: This information can also be found within the iStart system)

The following documents must be faxed to OIS to accompany the H-1B application.

Applicant Information:

  1. Copy of letter to immigration confirming employment details (see below)*
  2. Copy of applicant’s Curriculum Vitae, including a list of publications (if applicable)
  3. Proof that applicant has attained required degree

    • Ex: Copy of diploma/transcript that indicates the major field of study
  4. Copy of applicant’s passport identification page, including any extension pages
  5. Copy of any previous US immigration documents (if applicable)
    • Ex: I-797 Approval Notices, I-20s, DS-2019s, EAD card
  6. Copy of applicant’s current I-94 card (if applicable)
  7. Copy of applicant’s visa (if applicable)
  8. Letter from current employer verifying employment (if applicable)

    • Note: Employment with the other employer must continue until the new H-1 Petition is RECEIVED by the Department of Homeland Security.  Once we have received a receipt notice, an applicant may leave his/her current position and begin working at Indiana University.

* The letter to immigration confirming employment details, printed on department letterhead, should identify the following:

  1. Job title
  2. Salary
  3. Period of appointment.  IU will support H-1B Petitions for up to the statutory maximum of three years at a time.  Since H status extensions can be extended for an additional three years, please indicate in the letter if an extension beyond the initial three years is likely.
  4. Statement identifying the duties and responsibilities the international visitor will perform, and the education, training, and experience, which permit the visitor to perform these duties.
  5. Closing statement at the end of the offer letter that reads:

    I certify that the (Name of Department) will be liable for the reasonable costs of return transportation of the alien abroad if the alien is dismissed from employment by the (Name of Department) before the end of the period of H-1B authorized admission.

Dependent Information (if applicable)—For Dependents in the United States Wishing to Change to H-4 Status

  1. Completed Form I-539.  Click here for form.
  2. Check or money order in the amount of $300 payable to the Department of Homeland Security
  3. Proof of relationship to applicant
  4. Copy of dependent’s passport identification page, including any extension pages
  5. Copy of dependent’s current I-94 card
  6. Copy of dependent’s visa
  7. Copy of any previous US immigration documents (if applicable)

    • Ex: I-797 Approval Notices, I-20s, DS-2019s, EAD card
