By requesting to have an account accessible on the College Democrats at Indiana University Blog (hereafter “Blog”), you agree to be bound by these terms of use. If at any time you are found to be in violation of these terms your account will be suspended. College Democrats at Indiana University (hereafter “College Dems”) reserve the right to take particularly egregious violations of the terms of use to the university for further investigation.

Eligibility

Only Indiana University students who are members of the College Dems in good standing may have an account able to post, comment and have access to this Blog. If a member of the College Dems with access to the Blog graduates from the University and meets the following requirements, they may retain their ability to access the Blog:

1. They must remain in good standing with the College Dems as defined by the alumni statutes.
2. They must retain their access to their CAS authentication username and password.

Non-IU Persons

If a person who is not an IU student would like to post a guest editorial on the Blog, they may request to do so on the Contact Us page of this website. If granted, the requested post will be created through the account of another user.

Representations and Warranties

You represent and warrant that (a) all of the information provided by you to College Dems to participate in the Blog is correct and current; and (b) you have all necessary right, power and authority to enter into this Agreement and to perform the acts required of you hereunder.

Proper use

You agree that you are responsible for your own use of the Blog, for any posts you make, and for any consequences thereof. You agree that you will use the Blog in compliance with all applicable local, university, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence and all United States export control laws.

Content

The College Dems reserve the right to pull any content from the Blog that they deem inappropriate or any content that meets the following criteria as generally defined:

1. Hate speech
   1. Content that promotes hate or violence towards groups or a specific person based on race, ethnicity, religion, disability, gender, age, veteran status, or sexual orientation/gender identity
   2. Violent
   3. Pornographic
      1. Incest or bestiality
   4. Crude content
   5. Spam
   6. Advertisements for a product or service
   7. Malware, adware, viruses
   8. Impersonation of another person
   9. Personal or confidential information
   10. Material in violation of copyright
   11. Promotion of illegal activities

The College Dems also reserve the right to pull any content that they deem does not meet the ideological standards of the state or national Democratic party.

Content violations

The College Dems reserve the right to take any or all of the following actions for material violating the content rules:

1. Delete or hide the material in violation
2. Delete or hide any material previously posted by the user
3. Suspend or terminate a user’s access to the Blog
4. Demote the user’s standing within the College Dems
5. Notify the copyright holder
6. Report the content to the university
7. Report the content to law enforcement

Termination; Suspension

College Dems may, in its sole discretion, at any time and for any reason, terminate the Blog, terminate this Agreement, or suspend or terminate your account. In the event of termination, your account will be disabled and you may not be granted access to your account or any files or other content contained in your account although residual copies of information may remain in our system for some time for back-up purposes. Certain sections of the Agreement, along with applicable provisions of the general Terms of Use (including the section regarding limitation of liability), shall survive expiration or termination.

Indemnification

You agree to hold harmless and indemnify College Dems, and its subsidiaries, affiliates, officers, agents, volunteers, and employees from and against any third-party claim arising from or in any way related to your use of the Blog, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys’ fees, of every kind and nature. In such a case, College Dems will provide you with written notice of such claim, suit or action.

Entire Agreement

This Agreement constitutes the entire agreement between you and College Dems and governs your use of the Blog, superseding any prior agreements between you and College Dems. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other College Dems services, affiliate services, or third-party content.

Waiver and Severability of Terms

The failure of College Dems to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms of Use remain in full force and effect.

Statute of Limitations

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising of or related to use of College Dems Blog or the Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Choice of Law; Jurisdiction; Forum

These Terms of Use will be governed by and construed in accordance with the laws of the State of Indiana, without giving effect to its conflict of laws provisions or your actual state or country of residence. Any claims, legal proceeding or litigation arising in connection with the Blog will be brought solely in Monroe County, Indiana, and you consent to the jurisdiction of such courts.
