SAMPLE RENTAL LEASE
Students Living Until May (SLUM), Inc., as landlord, and Levon DeDorms and Mary Tappon-Keggs, as tenant(s), agree to a lease for the premises located at 420 Partyhouse Lane, Bloomington, Indiana, from the 15th day of August 2010 to the 14th day of August, 2011, subject to the conditions set forth in this lease.[i]
JOINT AND SEVERAL LIABILITY
All tenants living on the premises must sign the lease and all tenants signing this lease are held jointly and severally liable for breach of this agreement.[ii]
The tenant agrees to pay to the landlord as rent for the leased premises the sum of $850 per month. Monthly payments are to be made on the 1st day of each month, by delivery or mail to the office of the landlord. Payment sent by mail must be postmarked by the due date. If a check is returned for insufficient funds, the tenant acknowledges there will be a delinquent check fee of $25 per check for each check which is returned. A $5 per day fee will be charged each day the rent is late. [iv]
The tenant agrees to tender a security deposit in the amount of $850.
The tenant acknowledges that the landlord has the right to deduct damages from the deposit which exceed ordinary wear and tear.[vi]
CONDITION OF PREMISES AND PROVISIONS FOR JOINT INSPECTIONS
The tenant agrees to inspect the rental unit accompanied by the landlord within ten days of the beginning of occupancy of the premises andto complete a written inventory and damage list itemizing the damages present at the start of the tenancy.[vii]
The landlord agrees to inspect the rental unit personally, or by agent, accompanied by the tenant, at the end of the tenancy.[viii]
The landlord agrees to be responsible for the following maintenance duties:
Presentation of vermin-free premises.[x]
Keeping the premises, including all furniture and appliances furnished, in reasonable repair during the term of the tenancy, except when the disrepair has been caused by neglect conduct of the tenant or the tenant’s guests.[xi]
USE OF PREMISES
The tenant agrees to refrain from illegal acts or practices which unreasonably disturb neighbors;[xii] not to allow the premises to become cluttered with personal property, flammable material or other fire or safety hazards, or do or perform any hazardous act which might cause fire or increase insurance rates. Pets are prohibited unless written consent is given.[xiii]
ACCESS TO PREMISES[xiv]
The tenant agrees to permit the landlord reasonable access to exhibit the rental unit to prospective tenants. The tenant agrees to permitthe landlord or agent to enter the rental unit without prior notice is thelandlord or agent reasonably believes that an emergency exists. Landlord mayalso enter to perform necessary repairs or improvements.
The tenant agrees to be responsible for paying the charges and deposits for utilities needed to service the premises which are not furnished by the landlord and to maintain the heat in the unit to a minimum of sixty-two degrees (62°) during the winter months. It is the tenant’s duty to protect against freeze damage.
The landlord agrees to permit the tenant to sublease the leased premises for the duration of the term of the lease, or to sublease for any portion thereof, upon written consent of the landlord; consent shall not be unreasonable withheld.[xvi]
RULES AND REGULATIONS
Landlord may promulgate rules under this lease which are binding on the tenants and incorporated herein.[xvii]
It if becomes necessary to litigate a breach of this lease which, the prevailing party shall be awarded reasonable attorney fees.
This lease and its written endorsements constitute the entire extent of the agreement between the landlord and the tenant pertaining to the lease of these premises.
We do hereby agree to the foregoing lease and all its provisions.
